"VKontakte" is in the process of writing material for its site, and could not pass by two very suspicious moments.

1. The "site" in accordance with clause 1.1 of the agreement means

For example, some photos are located on a resource with a domain name vk.me or pp.vk.me. The vk.me domain (and therefore its subdomain pp.vk.me) is not a level of the vk.com domain, but a separate domain name. One might assume that vk.me refers to the aforementioned "other resources", but given the structure of the proposal, this seems doubtful.

Therefore, there is reason to believe that since the vk.me domain is not included in the network infrastructure according to the text of the agreement, then photographic (and other) works are used there. unlawfully since VKontakte has not received such permission from users.

2. The granting of the right to use the content to other users is governed by clause 7.1.3 of the agreement, set out as follows:

“The user, posting on the Site the Content that belongs to him legally, provides other users with a non-exclusive right to use it exclusively within the framework of the functionality provided by the Site, by viewing, reproducing (including copying) and other rights solely for the purpose of personal non-commercial use, except in cases when such use inflicts or may harm the legally protected interests of the copyright holder. "

However, even taking into account the "benefits" provided for by Art. 1286.1 of the Civil Code of the Russian Federation, this condition does not fully meet the general requirements provided for in Art. 1235 of the Civil Code of the Russian Federation for licensing agreements. According to clause 5 of the named article, "in the absence of a condition on the amount of remuneration or the procedure for determining it in the paid licensing agreement, the agreement is considered not concluded."
Clause 13.6 of the Resolution of the Plenum of the Supreme Court of the Russian Federation No. 5, Plenum of the Supreme Court of the Russian Federation No. 29 of March 26, 2009 "On some issues arising in connection with the introduction of part four of the Civil Code of the Russian Federation" (hereinafter - Resolution 5/29) provides:

“Based on paragraph 5 of Article 1235 of the Civil Code of the Russian Federation, the license agreement is assumed to be compensated, unless the agreement itself expressly provides otherwise. Hence, if the license agreement does not directly provide for its gratuitousness, but at the same time it does not agree on a condition on the amount of remuneration or on the procedure for determining it, the corresponding agreement by virtue of paragraph two of paragraph 5 of Article 1235 of the Code is considered not concluded. "

In clause 7.1.3 of the agreement, it is not said about the granting of rights free of charge, unlike, for example, 7.1.5, in which clearly it is stated that the right is granted “free of charge”. The term "solely for the purpose of personal non-commercial use" does not mean the explicit gratuitousness of the grant of the right. Consequently, in my opinion, the explicit gratuitousness of granting the right is not provided here. And therefore, the applicability of clause 7.1.3 of the agreement in the currently valid edition seems to me to be controversial.

Another option is that in this way the administration wants to improve the quality of the content. As practice shows, communities with unique author's content, and not tons of copy-paste, have good natural growth.

Maybe all four tasks are being solved at once.

From my point of view, the income of those who promoted with the help of cross-advertising will plummet. The natural statistics of many publics are actually pretty dull. There are often more unsubscriptions from the group than subscriptions, the attendance is 2-4 times lower. Many advertisers will simply stop buying ads there if they know how to analyze statistics a little bit. Admins should start writing high-quality unique content and hope that the VK team will limit the number of posts per day. Then the users 'feed will be very much cleared, the number of users' attention per post will increase and, accordingly, the amount of attention to advertising will increase. It was high time to put the news feed in order. VKontakte was drowned in community exchanges and advertising. I am also far from the most decent administrator, and I know what night crosses are, or a bunch of advertisements, but still I agree with the new rules.

VKontakte is fighting the consequences, not the cause. The administrators did a lot of exchanges for a reason. This was due solely to the poor return on posts, and every day it got worse and worse. All this is due to the large number of not only ads, but also content.

It is impossible to generate 100 unique posts per day, and no one does this, and the statistics must be kept at the level. Because of all this, we have a low return on posts. I doubt that people go to the feed and flip through all these two thousand posts.

I own several million VKontakte, and the coverage of one post is about 25 thousand subscribers. What is 25 thousand from a million? The return per post is small, and as a result, more exchanges with other communities had to be done. The large number of exchanges and advertisements was far from the fact that we were allowed to, and we were not punished for it. The administrators just wanted to grow and raise new communities.

Only a limit on the number of publications can save you from such spam with old content. Then the administrators will already select posts and try to interest subscribers with the content and its quality.

I talked to many admins and they all liked 20 posts for content and five for ads. If you apply such a posting, then the news feed of subscribers will quickly be cleared of all junk and second-rate content. We will get a clean feed, good content, high reach of one post, and, therefore, high return on advertising. And that's all we need.

As the return on advertising grows, so will the price of it. Then the allowed five posts will be equal to 10 advertising posts, and this is more than enough. Plus, there will be no spam. It will become easier to develop, and it will become more pleasant to buy advertising.

Now administrators have no choice left, and everyone will try to develop due to the number of posts, and only a small proportion of administrators will look towards quality. What's the point of making 20 quality posts when they get lost in the feed among thousands of old posts from other communities? So the coverage of posts will be as low, advertising prices will not rise, which is why many administrators panic.

While I was writing this text, some have already been blocked for reposting. They decided to bypass the new rules and make mutual reposts between thematic communities. It didn't work out.

We believe that communities should grow with interesting, unique content. Such worthy communities will find their followers. Now we are in a situation where the stamping of new communities is on stream. When people start talking about the impossibility of "raising" a new young community, in nine cases out of ten we are talking about another humorous public without a clear concept, which either takes material from other communities, or generates its own, but of very low quality.
